I just can't decide, if temp ban or perm ban is the right thing to do.
Morally, temp ban seems too mild.
Legally, on the other hand... If you look at the EULA and actual laws, the rules are more than a little fluffy, and we all know MAs communication skills aren't exactly brilliant.
I mean... Which part of the EULA is it that they have breached? Harrasment, when sending 20 summons requests? Yes maybe. But that doesn't qualify for a perm ban.
Exploit? Hmm... It's not an exploit of a BUG.
I suppose it's still an exploit. But more like 'unintended use of a feature'. Much like VTol hunting, which took MA nearly a year to decide was illegal. And until then we didn't really have any way to know for sure. And like trapping which took MA what.. 4 years to do something about?
Maybe MA can confiscate their profit from this 'exploit', but that might not be simple at all to calculate. And if MA doesn't have 100% legal certainty, MA risks getting sued.
(All the mumbo-jumbo in the EULA that we have no rights what-so-ever, doesn't hold up in the swedish court, because this is real people and their real money we are talking about)
So... As much as I agree morally with the majority of posters who want to see their head roll (well almost), it's just not that simple for MA.
Still, they were intentionally preying on other people mistakes or lacking knowledge of the consequences, for their own profit. Surely a harsh punishment is in order.
Conclusion: I still can't decide between temp or perm ban.
