Update:
Went hunting in afternoon ad again I got 3 crits in a row
Never got them before so must be related to some of my skills getting better. My Laser pistoleer hit is now 58, Critical Hit Ability on my handgun is 7.6. Maybe at 7.6 CHA you start getting this.
